CalFire redrew the fire hazard map for the North Coast and Bay Area on February 24, 2025, and the update quietly changed what a Tiburon or Belvedere seller has to hand a buyer at the listing table. The Tiburon Fire Protection District's coverage area came back Moderate. Only Angel Island State Park kept the Very High designation. Four months later, on June 24, 2025, the district's board made the new tier official by adopting Ordinance No. 132.
State law ties the mandatory Fire Hardening and Defensible Space disclosure, the form most agents call the FHDS, specifically to High or Very High zones. Moderate doesn't trigger it. That means most of the peninsula's sellers are no longer legally required to complete a form that many agents, title companies, and disclosure vendors still add out of habit, because for years the assumption on the Tiburon Peninsula was that hillside meant high hazard.
The Map That Moved First
The reclassification looks like a downgrade, but the backstory is stranger than that. Government Code Section 51178 now requires the State Fire Marshal to identify Moderate and High zones in addition to Very High. Previous LRA maps only contained the Very High tier at all. Tiburon's coverage area was never officially graded as anything else before this rollout, because the three-tier system didn't exist on paper until now. The February 2025 map isn't a downgrade so much as the first time the state assigned this stretch of Marin a formal grade below the top tier.
Ordinance No. 132, in Two Steps
The fire district moved through the required sequence on a public timeline. A first reading, in title only, happened May 7, 2025. The public hearing for adoption followed on June 11, 2025. The board adopted the ordinance on June 24, 2025, then had 30 days to submit it back to CalFire. The Town of Tiburon ran its own parallel process for the incorporated area, taking up its version of the map for council review on June 4 and June 18, 2025. Two governing bodies, two adoption tracks, one shared map.
What the Moderate Tier Actually Exempts
The FHDS disclosure only applies when three conditions are all true:
- The property is a one-to-four-unit residential building, including condominiums, common interest developments, or manufactured homes.
- The seller is required to complete a Real Estate Transfer Disclosure Statement.
- The property sits in a High or Very High fire hazard severity zone.
Miss any one of the three and the paragraph doesn't have to be completed. For a Tiburon parcel now mapped Moderate, condition three fails on its own, regardless of what the first two conditions say. A 2008 hillside home near Ring Mountain and a flat lot on Beach Road land in the same bucket under the current map: neither triggers the mandatory form.
The Peninsula Still Talks Like a Fire Zone
The paperwork threshold moved. The operational posture didn't. Tiburon Fire still runs annual Wildland Urban Interface inspections across its jurisdiction and will send an inspector to any property outside the WUI boundary on request. At a joint wildfire preparedness forum convened by the Belvedere and Tiburon mayors in February 2025, Tiburon Fire prevention specialist Django "DJ" Heckler laid out the zone system residents are still expected to maintain regardless of what the state map says about disclosure triggers:
"The immediate zone or 0 zone is a 5 foot perimeter around your home."
That's the language of a district treating itself as wildfire-exposed, mapped tier notwithstanding. Belvedere's constrained access points and the peninsula's overall geography haven't changed because a map redrew a boundary line.
Insurance Doesn't Read Ordinances
Carriers underwrite with their own catastrophe models, not the state's official severity tier. Tiburon and Belvedere have generally retained somewhat better access to standard-market coverage than Marin's inland hillside communities, but that's a relative statement, not an exemption. Hillside and ridgeline parcels on the peninsula, particularly above Tiburon Boulevard toward Ring Mountain and Sugar Loaf, still face closer underwriting scrutiny and a real chance of landing on the California FAIR Plan paired with a Difference in Conditions policy for full coverage. None of that turns on whether a state ordinance calls the zone Moderate or Very High. A buyer who skips a pre-offer insurance quote because the FHDS box wasn't checked is solving the wrong problem.

Zone 0's September Reversal
The other regulatory piece to track is Zone 0, the proposed statewide ember-resistant standard for the five feet immediately around a structure. The Board of Forestry approved a final draft on August 19, 2026, by an 8-0 vote. The board filed it as an emergency regulation on August 28. Then, on September 8, 2026, that filing was pulled back for further review. As of this writing, no statewide Zone 0 requirement is in force anywhere in California.
Even once a version clears review, the rule as approved applies to State Responsibility Areas and to Very High fire hazard severity zones inside Local Responsibility Areas. It would not automatically reach a Moderate-zone parcel on the Tiburon Peninsula unless the town or the fire district separately adopts an ordinance extending it, something neither body has done. For most Tiburon sellers, Zone 0 is a state process to watch, not a compliance date to plan a listing around this year.
A Practical Sequence Before You List or Offer
- Confirm your parcel's current tier directly through Tiburon Fire Protection District's own fire hazard severity zone page rather than relying on an older natural hazard disclosure report that may predate the June 2025 ordinance.
- If your address maps Moderate, note that the FHDS form isn't legally triggered, but keep any hardening documentation on file anyway. Insurers ask for it independent of what the state disclosure form requires.
- Get a fire-insurance quote before you write or accept an offer, not after escrow opens.
- If you want a defensible space inspection despite sitting outside the mandatory WUI boundary, Tiburon Fire will schedule one on request through its prevention bureau.
- If brush clearing is part of your pre-listing prep, plan around the district's chipper program at Blackie's Pasture. It runs the second Saturday of the month from May through September each year. The 2026 season wrapped on September 12, so the next window opens in May 2027.
FAQ
Does the Moderate reclassification mean Tiburon homes are no longer considered fire risk properties? No. The map change reflects the first time the state's three-tier system was formally applied here, not a change in the peninsula's underlying exposure. The fire district's inspection program and most insurers' underwriting models haven't moved in step with the paperwork threshold.
What about parcels above Tiburon Boulevard near Ring Mountain or Sugar Loaf? The current LRA map covers the Tiburon Fire Protection District's jurisdiction as Moderate overall, with Angel Island carved out as Very High. That means hillside parcels fall under the same disclosure threshold as flatter ones under the current map. Buyers evaluating a specific address should confirm the parcel's tier directly rather than assume by elevation or neighborhood.
Will Zone 0 apply to my property once it's finalized? Only if your parcel sits in a State Responsibility Area or a Very High fire hazard severity zone, or if Tiburon's town council or fire district later adopts a local ordinance extending the rule to Moderate-zone parcels. Neither body has taken that step as of this writing.
